Request to book facilities at a Swim, Sport, and Leisure Centre

Conditions of hire

1. City of Greater Geelong reserves the right not to accept the hire application or to cancel the booking at any time.
2. Subletting of the facility is not permitted.
3. The hirer shall comply with all signage in the centre and follow directions given by authorised City of Greater Geelong staff regarding the use of the facility. In the event of an emergency, all staff instructions are to be followed.
4. The hirer is only permitted to access and use the part of the facility that is specifically the subject of this Facility Hire Agreement. Access to other pools and dry areas outside this Agreement is not permitted.
5. The following rules apply at the facility:
   • No alcohol is permitted.
   • No smoking is allowed.
   • No glass items are allowed.
   • Children U5 must be within arm’s reach of, and actively supervised by, a parent or guardian over the age of 16.
   • Littering, running, swearing bombing, dunking, pushing persons into the pool and other anti-social behaviour is not allowed.
   • Diving is not permitted.
6. Any hirer and/or other persons not complying with or enforcing the provisions of these conditions may be directed to leave the facility by authorised City of Greater Geelong staff or removed by Police.
7. Government schools must comply with any Victorian State Government guidelines or requirements concerning school excursions and provide the centre with evidence of compliance if requested.
8. City of Greater Geelong takes no responsibility for the property of any hirer whilst at the facility nor does City of Greater Geelong accept any responsibility of the property of any person the hirer allows into the pool facility and without limiting the scope of the following indemnity clause, the indemnity from the Hirer to the City of Greater Geelong shall include such damage to property.
9. Any motor vehicle driven or parked in the confines of the facility is entirely at the owners risk and no responsibility is accepted by the City of Greater Geelong for any theft or damage thereto and without limiting the scope of the following indemnity clause, the indemnity from the Hirer to the City of Greater Geelong shall include such theft or damage.
10. The hirer is to notify authorised City of Greater Geelong staff of any damage that occurs during the hire period. The hirer shall be responsible for all damage caused to the facility during the period of hire and will be required to pay the costs of all repairs.f
11. The hirer must advise staff at the centre immediately if they become aware of any incident or injury whilst on site.
12. If the swimming pool is hired for competitive swimming or teaching swimming or teaching or practising a related water sport, the following shall apply:
    • All swimming teachers are required to hold a current AUSTSWIM Teacher of Swimming and Water Safety Certificate or an equivalent qualification. The trainer(s) for competitive swimming or other related water sports should hold valid accreditation(s) relevant to the sport. A copy of these qualifications is to be supplied with the signed Hire Agreement.
    • The hirer, his/her servants or agents conducting the swimming classes must observe all Royal Life Saving Society Australia (RLSSA) guidelines.
13. Schools undertaking their own swim teaching lessons must ensure that student/staff ratios are in accordance with the ‘Guidelines for Safe Pool Operation’. Clarification of permitted numbers may be obtained from the centre at the time of booking.
14. If the swimming pool is hired for structured leisure activities, the hirer, his/her servants, or agents shall ensure that no persons under their control and/or anyone invited to the pool by the hirer shall be allowed to perform a recreational dive from a platform or starting block into water less than 2000mm in depth and from poolside not less than 1800mm in depth.
15. Photographs may only be taken of the participants with the consent of centre management. If consent is granted, the person taking permitted photographs must wear an authorised photographer vest at all times.
16. Applications for hiring of City of Greater Geelong properties will not be considered where any rental or charge remains unpaid from a previous hiring, or the conditions of occupancy have not been adhered to.
17. Hire groups may give notice of their intention not to use their allocations / or part of their allocation of facilities by giving at least 2 weeks’ notice of such. Failure to notify within this time frame will result in the group being charged the applicable rate.
18. The hirer assumes full responsibility for supervision of all persons under their control and accepts that injury or drowning is a risk of aquatic activities. Accordingly, the hirer waives, to the full extent permitted by law, any legal rights the hirer may otherwise have against the City of Greater Geelong and/or its servants and agents.

Liability Insurance

19. The hirer holds a current Public Liability Policy of insurance in respect of the activities specified in these Conditions of Hire in the name of the hirer providing coverage for at least $10m per event.

Indemnity

20. The parties:
    1. acknowledge that the hirer is insured with the Victorian Management Insurance Authority (VMIA) and the City of Greater Geelong is a municipal council within the meaning of the Local Government Act 2020 and is insured by Liability Mutual Insurance (LMI).
    2. agree that it is unnecessary to include insurance or indemnity provisions in these Conditions of Hire.
    3. agree that the insurances of the Hirer and the City are adequate to cover their respective risks under these Conditions of Hire.
    4. agree that any liabilities or losses arising under this document will be determined having regard to the common law.

The parties acknowledge that an amendment to these Conditions of Hire will be required if a party ceases to hold insurance with its relevant insurer.

The hirer agrees to indemnify and to keep indemnified, and to hold harmless the City of Greater Geelong, its servants and agent, and each of them from and against all actions, costs, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them, or any of them, arising out of or in relation to this agreement.
