Question Time is an opportunity for questions to be addressed to Council and while the minutes record the general content, they do not purport to be a transcript of what was said by individuals. Likewise Councillor or Officer verbal responses are in summary form only. Views expressed may not be the views of Council.
Council's practice is to provide a separate document on its website setting out questions and responses including any more detailed written responses which may be provided subsequent to the meeting.
Colin Wallace asked that following advice given to my wife and me by a lawyer specialising in planning law, it is evident that Council has breached that part of the Ropeworks Section 173 Agreement that required Council to provide to the owner/permit holder half-yearly reports for up to five years from the date of the opening of the supermarket, in that, to the best of my knowledge, Council did not provide any of the half-yearly reports to Woolworths or the subsequent owner and it is also evident that Section 114 of the Planning and Environment Act does not preclude this from being the legitimate business of my wife and me. In the light of these things, would you, Mr Mayor, consider the possibility that Council’s breach of part of the Ropeworks Section 173 Agreement by not providing any of the half-yearly reports to Woolworths or the subsequent owner was deliberate?
Cr Heagney responded questions in relation to the Ropeworks and First Street have been discussed extensively, and as advised in recent correspondence, this matter will not be discussed further.
The Mayor concurred with Cr Heagney’s comments.
Mary Wallace asked:
In the Minutes of the 27th May 2014 Council Meeting held at Corio, why is it concealed that Cr Andy Richards spoke at some length in response to my question without answering it?
Why is the question I asked at the 27th May 2014 Council Meeting at Corio unanswered to this day?
Keeping in mind that Keith Fagg resigned as Mayor on the 16th August 2013, I am asking, since Mayor Keith Fagg had been granted leave from the 3rd to the 9th August 2013 and had returned from this period of leave, attending in his mayoral role a function at Geelong Trades Hall two days later on Sunday 11th August 2013, why did Cr Andy Richards mislead the Council Meeting of Tuesday 13th August 2013 by requesting an extension of leave for Mayor Fagg from the 5th August 2013 instead of requesting an additional period of leave from the 12th or 13th August 2013?
Cr Richards advised his response is the same as that provided at the 27 May Council Meeting.
Cr Richards also expressed his belief that someone must have requested that he move the extension of leave.
Cr Farrell presented a petition containing 213 signatures from “Friends of the Old Netball Courts Reserve”. The required action is to enable genuine engagement with the community to ascertain the feasible future use/s of the subject land for community purpose. The petitioners respectfully request that Council defer the proposed Amendment C299 and proposed sale of land until after completion of the review of Council’s Open Space Strategy and Policy.
Cr Farrell moved, Cr Fisher seconded –
That Item 16, “Contractual Matter” be moved from Confidential for discussion in the open forum.
The vote was tied and the Mayor exercised his casting vote.
Lost.
Division requested:
